Terms of service

1. About us

This website is operated by Beril Oktem, trading as BERIL OKTEM ("BERIL OKTEM", "we", "us" or "our"). Our contact details are:

Email: beril.oktm@gmail.com
Telephone: 07721 967093
Address: 205 Falcon Works Court, 8 Copperfield Road, London E3 4RT, United Kingdom

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to sell our products to you.

These terms and conditions (the "Terms") apply when you use our website or purchase products from us. Please read them carefully before placing an order.

Nothing in these Terms affects any rights you have under consumer law.

2. Who may use the website

You must be at least 18 years old and legally capable of entering into a contract to place an order. If you are under 18, an order must be placed by your parent or legal guardian.

You must ensure that all information you provide is accurate, current and complete. If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account. Please contact us promptly if you believe your account has been used without permission.

3. Our products

We take reasonable care to describe and display our products accurately. However:

  • colours may appear differently depending on your screen and device settings;
  • handmade and made-to-order pieces may have minor variations in colour, texture, finish, measurements or placement; and
  • images, styling and props used in photographs are illustrative unless the product description states that they are included.

These normal variations are not necessarily faults. They do not affect your rights where a product is faulty, not as described or otherwise fails to meet the standards required by law.

Measurements and sizing information are provided as a guide. You are responsible for checking the product description and sizing information before ordering. If you are unsure about sizing, contact us before placing your order.

We may change or discontinue products and may limit quantities or availability, but changes will not affect orders we have already accepted.

4. Made-to-order, personalised and pre-order products

Some products may be handmade, made to order, altered to your measurements, personalised or offered on a pre-order basis. The relevant product page will identify this where applicable and will provide an estimated production or dispatch timeframe.

You are responsible for checking that any measurements, spelling, colours and other specifications you submit are correct. Please contact us immediately if you notice an error. We cannot promise that a requested change will be possible once work has begun.

The usual 14-day right to cancel a distance contract does not apply to goods made to your specifications or clearly personalised. This exception does not affect your rights if the goods are faulty, not as described or otherwise do not conform to the contract.

5. Placing an order and formation of the contract

The products displayed on our website are an invitation to place an order, not an offer by us to sell. By submitting an order, you make an offer to purchase the products in your basket.

After you place an order, we will send an acknowledgement email. This confirms that we have received your order but does not mean that we have accepted it. A binding contract is formed when we send you an order or dispatch confirmation, whichever occurs first.

We may decline or cancel an order before acceptance, including where:

  • a product is unavailable;
  • payment is not authorised;
  • there is an obvious pricing or description error;
  • we cannot deliver to the address provided;
  • purchase limits apply; or
  • we reasonably suspect fraud, misuse or an order placed for unauthorised resale.

If we cancel an order after taking payment, we will refund the amount paid using the original payment method.

Please review your order carefully before submitting it. If you want to change or cancel an order, contact us as soon as possible. Your statutory cancellation rights are explained in section 9 and our Returns Policy.

6. Prices, payment and promotions

Prices are shown in the currency selected on the website. Unless stated otherwise, prices include VAT where VAT is applicable. Delivery charges are shown separately before you place your order.

For deliveries outside the United Kingdom, the recipient may have to pay import duties, taxes, customs charges or handling fees. These charges are not included unless expressly stated at checkout and are the recipient's responsibility. We recommend checking local requirements before ordering.

Payment must be made using a payment method available at checkout. You confirm that you are authorised to use the payment method supplied. Payment may be processed by Shopify or another third-party payment provider under that provider's terms and privacy policy.

Promotional offers and discount codes may be subject to separate conditions, expiry dates and exclusions. Unless stated otherwise, they cannot be combined, exchanged for cash or applied retrospectively.

If a price is clearly incorrect and the error could reasonably have been recognised, we may cancel the order and refund you even if we have already accepted it.

7. Delivery

Available delivery methods, charges and estimated timeframes are displayed at checkout or in the relevant product description. Production time for made-to-order or pre-order products is additional to the delivery estimate unless stated otherwise.

We will deliver within the timeframe agreed with you or, if no timeframe has been agreed, without undue delay and no later than 30 days after the contract is formed, unless a longer period is stated and agreed for a made-to-order or pre-order product.

Delivery dates are estimates unless we expressly agree that a particular date is essential. We are not responsible for delays caused by events outside our reasonable control, but we will contact you and take reasonable steps to minimise the delay. Your legal rights in relation to late delivery remain unaffected.

You are responsible for providing a complete and accurate delivery address. If an order is returned because the address was incorrect, incomplete or the parcel was not collected, we may charge the reasonable cost of redelivery.

For consumer orders, the product remains at our risk until it is delivered to you or to a person identified by you to receive it. If you independently arrange for a carrier that we did not offer, risk passes when we hand the product to that carrier.

Please inspect your parcel on arrival and contact us promptly if it is missing, damaged or incorrect. This helps us investigate but does not reduce your statutory rights.

8. Ownership

You own the product once we have received payment in full and the product has been delivered to you, whichever occurs later.

9. Cancellations, returns and refunds

This section summarises your rights. Further practical instructions are set out in our Returns Policy. If there is any conflict, your statutory rights take priority.

9.1 Change-of-mind cancellation rights

If you are a consumer in the United Kingdom and buy online, you will usually have the right to cancel your order without giving a reason from the date the contract is formed until 14 days after the day you, or a person nominated by you, receives the goods.

To cancel, email beril.oktm@gmail.com with a clear statement that you wish to cancel. You may use the model cancellation form at the end of these Terms, but you do not have to.

You must return the goods within 14 days after telling us that you wish to cancel. Unless the goods are faulty, incorrect or our Returns Policy says otherwise, you are responsible for the direct cost of returning them. We recommend using a tracked and appropriately insured service.

We will refund the product price and the cost of our least expensive standard delivery option. We may withhold the refund until we receive the goods or you provide evidence that you have sent them back. We will make the refund within 14 days after the relevant event, using the original payment method unless agreed otherwise.

You may inspect goods as you would in a shop. We may reduce a refund to reflect any loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

9.2 Exceptions to change-of-mind cancellation

The statutory change-of-mind cancellation right does not apply to certain products, including:

  • goods made to your specifications or clearly personalised; and
  • sealed goods which are not suitable for return for health protection or hygiene reasons, once unsealed, where that exception lawfully applies and was made clear before purchase.

This does not affect your rights where a product is faulty, not as described or otherwise does not conform to the contract.

9.3 Faulty or misdescribed products

We are under a legal duty to supply goods that conform to the contract. Goods must be as described, fit for purpose and of satisfactory quality. If a product does not meet these requirements, you may have legal rights to reject it, or to require repair, replacement or a price reduction, depending on the circumstances and applicable law.

Contact us at beril.oktm@gmail.com with your order number and details of the issue. Where goods are confirmed to be faulty or misdescribed, we will cover reasonable return costs.

10. International orders

If you order from outside the United Kingdom, you are responsible for ensuring that the products can lawfully be imported into and used in the destination country. Customs authorities may open and inspect packages.

Mandatory consumer protections in your country may apply in addition to these Terms. Nothing in these Terms excludes rights that cannot lawfully be excluded.

11. Website use

You may use the website only for lawful, personal and non-commercial purposes. You must not:

  • misuse the website, introduce malicious code or attempt unauthorised access;
  • interfere with the website's operation or security;
  • use the website to commit fraud or breach any law;
  • scrape, harvest or extract content or personal data by automated means without our written permission;
  • impersonate another person or submit false or misleading information; or
  • use our content, products or designs to create or promote counterfeit or infringing goods.

We may suspend or restrict access where reasonably necessary to protect the website, our rights, our customers or third parties.

12. Intellectual property

All intellectual property rights in the website and its content, including our name, branding, logos, garment and product imagery, text, graphics, videos, artwork and website design, belong to us or our licensors.

You may view the website and make copies strictly for your own personal, non-commercial use. You may not reproduce, modify, distribute, sell, license, publish, commercially exploit or create derivative works from our content without prior written permission, except where the law permits.

No transfer of ownership in a physical product transfers any intellectual property rights in its design, imagery or branding.

13. Reviews and other content you submit

If you submit a review, image, comment or other content to us, you confirm that it is your own content or that you have permission to submit it, and that it is accurate, lawful and does not infringe anyone else's rights.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit and display that content for operating and promoting our business. This licence does not transfer ownership of your content to us. We will handle personal data shown in submitted content in accordance with our Privacy Policy.

We may remove content that we reasonably consider unlawful, misleading, offensive, infringing or in breach of these Terms. We are not obliged to publish or respond to submissions.

14. Third-party services and links

Our website may use or link to services operated by third parties, such as Shopify, payment providers, social-media platforms and delivery companies. We do not control third-party websites and are not responsible for their content or availability. Your use of a third-party service may be subject to that provider's own terms and privacy policy.

Nothing in this section limits our responsibility where a third party acts on our behalf in fulfilling our contract with you.

15. Privacy

We process personal data in accordance with our Privacy Policy. Shopify also processes certain personal data to provide its platform services. Information may be processed outside the country where you live, subject to the safeguards described in the applicable privacy notices.

16. Our responsibility to you

We do not exclude or limit liability where it would be unlawful to do so. This includes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory rights in relation to products; or
  • any other liability that cannot lawfully be excluded or limited.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if both parties knew, when the contract was formed, that it might happen.

We supply products for private use. If you use a product for a commercial, business or resale purpose, we will not be responsible for business losses such as loss of profit, revenue, business, opportunity, anticipated savings or data, except where the law does not allow that liability to be excluded.

We are not responsible for loss caused by your failure to follow care, storage or use instructions, or by misuse, unauthorised alteration, normal wear and tear, or an event outside our reasonable control, except to the extent that the law provides otherwise.

17. Events outside our control

We are not liable for delay or failure caused by an event outside our reasonable control. If such an event affects your order, we will contact you as soon as reasonably possible and take reasonable steps to reduce its effects. If there is a substantial delay, you may contact us to end the contract and receive a refund for products you have paid for but not received, subject to applicable law.

18. Ending or suspending website access

We may suspend, withdraw or restrict all or part of the website for operational, security or legal reasons. We may also suspend or close an account if you materially breach these Terms. Ending website access does not affect rights, obligations or liabilities that arose before termination.

19. Changes to these Terms

We may update these Terms from time to time. The version in force when your order is accepted will apply to that order. Any changes will apply to later use of the website and later orders from the date the updated Terms are posted. Where required by law, we will give appropriate notice of material changes.

20. Other important terms

If any part of these Terms is found unlawful or unenforceable, the remaining provisions will continue in effect.

If we delay enforcing a right, that does not waive it. Each provision operates separately.

We may transfer our rights and obligations under these Terms to another organisation, provided this does not reduce your rights. You may transfer your rights or obligations only with our written consent, except where the law allows otherwise.

These Terms are between you and us. No other person has a right to enforce them, except where applicable law provides otherwise.

21. Governing law and disputes

These Terms and any contract between us are governed by the laws of England and Wales.

If you are a consumer resident in another part of the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom where you live. If you live outside the United Kingdom, you may have additional mandatory rights under local law.

Please contact us first at beril.oktm@gmail.com so that we can try to resolve any concern directly.
